King Mining Corporation Limited
Mine Visit Services — Terms of Service
Effective date: 27 August 2026
These Terms of Service govern requests, bookings and participation in mine visits and related services arranged by King Mining Corporation Limited. Please read them carefully before submitting a request or making payment.
1. Acceptance and scope
These Terms of Service (the “Terms”) form an agreement between King Mining Corporation Limited, an Afghanistan-registered company with registration number 126168 and an address at Karte 4, Kabul, Afghanistan (“King Mining,” “we,” “us” or “our”), and the person or organization requesting or purchasing a service (“Client,” “you” or “your”). A person attending a visit is referred to as a “Visitor.”
The Terms apply when you submit a mine-visit request, accept a quotation or written service confirmation, make payment, or participate in a visit or related activity. If you request services for an organization, you confirm that you have authority to act for that organization. The Client must provide these Terms to every Visitor included in the booking and ensure that each Visitor complies with them. King Mining may also require each Visitor to sign a separate safety, confidentiality or site-access acknowledgement.
A written quotation, invoice, itinerary or booking confirmation may contain service-specific conditions. If a service-specific written condition conflicts with these Terms, the service-specific condition will control only for the affected booking and only to the extent of that conflict.
2. Eligibility and screening
Mine Visit Services are available only to adults aged 18 or older who seek access for a legitimate business, investment, technical, professional or governmental purpose. The service is not open to the general public or for recreational tourism.
Submitting a request does not create a right to visit any mine. King Mining may verify the identity, company affiliation, business purpose and suitability of a proposed Client or Visitor. We may request passports or other identification, company registration documents, professional credentials, references, itinerary information or other documents reasonably required for compliance, government processing, safety or security review.
King Mining reserves the right to accept, decline, suspend or cancel any request or prevent any individual from entering or remaining at a mine, project, facility or restricted meeting area where we, a mine owner or operator, a competent authority or a security provider consider it necessary or appropriate.
3. Requests, estimates and booking confirmation
Information and prices displayed on the website produce a preliminary service estimate only. They do not constitute a confirmed booking, guaranteed price, permit, authorization or promise of mine access.
A booking becomes confirmed only when:
- King Mining has reviewed and approved the request in writing;
- the Client has supplied all documents and information requested by King Mining;
- the Client has accepted the final written scope, price and proposed schedule; and
- King Mining has received cleared payment in full for each confirmed King Mining service.
Mine access remains subject to required government, mine-owner, operator, security and local approvals. Written booking confirmation does not override the decision of any competent authority, mine owner, mine operator or person responsible for site safety or security.
4. Available services
Subject to availability, written approval and any required authorization, King Mining may provide or coordinate services including:
- mine-access applications, registration and authorization coordination;
- invitation letters and visa-support documentation;
- local engineers, technical personnel and Afghan translators;
- road transportation, vehicles, drivers and fuel;
- airport reception and local arrival coordination;
- hotel or other suitable accommodation;
- meals supplied by hotels, restaurants or catering providers;
- security coordination where available and permitted;
- sampling, chain-of-custody and laboratory-analysis coordination;
- site-specific protective equipment or safety arrangements where stated; and
- other visit-related services agreed in writing.
Only the services expressly listed in King Mining’s final written confirmation are included. Any service not listed is excluded. Descriptions, schedules and itineraries may need to change because of authorization, security, weather, road, mine, operator or logistical conditions.
5. Prices, currencies and payment
Final prices are stated in King Mining’s written quotation or invoice. Payment is due in full for each confirmed service. Unless King Mining expressly agrees otherwise in writing, cleared funds must be received no later than 14 calendar days before the Visitor’s expected arrival or the first scheduled service date, whichever occurs first.
King Mining accepts payment in United States dollars (USD) or Afghan afghanis (AFN) through a payment method approved by King Mining. Any AFN amount shown beside a USD price on the website is a local fee reference and may be updated. Where a currency conversion is required, the exchange rate stated in the final quotation or invoice will apply.
The Client is responsible for bank charges, intermediary-bank charges, transfer fees, currency-conversion costs and any taxes or charges identified in the final quotation or invoice. King Mining must receive the full invoiced amount in cleared funds. We are not required to begin government processing, make reservations, commit personnel or confirm arrangements before full payment and required information have been received.
If payment is late, King Mining may release reserved dates, personnel or other arrangements. A late payment does not oblige King Mining to complete approval or arrangements within the original schedule.
6. Changes requested by the Client
Any request to change the date, destination, mine, project, route, number of Visitors, duration, accommodation, transportation, personnel or other service is subject to availability and written approval.
King Mining does not charge a penalty merely because the Client requests a change. However, the Client must pay any additional cost caused by the change, including updated supplier prices, replacement reservations, government charges, additional personnel, transport, accommodation, exchange-rate differences or other external costs. No change is effective until confirmed by King Mining in writing and any additional payment has been received in cleared funds.
7. Third-party providers
Hotels, restaurants, caterers, transport operators, laboratories, security providers, mine operators and other independent providers may perform parts of a visit. Where King Mining includes a third-party component in its confirmed service, King Mining’s role is limited to the coordination expressly described in the written confirmation. The independent provider remains responsible for its own facilities, personnel, services and operational decisions.
Where the Client contracts with or pays a third party directly, that transaction is separate from the Client’s agreement with King Mining and is governed by the third party’s own terms and refund policy. King Mining is not a party to that transaction and has no obligation to request, negotiate, collect, guarantee or advance a refund from the provider. Any request concerning a direct third-party payment must be made separately by the Client to that provider.
8. Government documents, visas and authorization
King Mining may prepare invitation letters or supporting documents and may coordinate applications, registration or communications relating to a proposed visit. King Mining does not issue visas and cannot guarantee that a visa, permit, registration, authorization, security clearance or mine-access approval will be issued, issued by a particular date, or remain valid. Those decisions belong exclusively to the competent authorities and authorized site controllers.
Unless expressly included in the written confirmation, each Visitor is responsible for obtaining and maintaining a valid passport, visa and any travel, transit or entry documentation required for the visit. The Client and every Visitor must provide accurate, complete and current information. King Mining is not responsible for delay, rejection, cancellation or additional cost caused by incomplete, inaccurate, inconsistent or late information supplied by the Client or Visitor.
Government-related document, application, registration, permit, authorization and processing amounts are non-refundable once the relevant work, submission, registration or commitment has begun, including where an authority delays, declines, suspends or later withdraws the requested authorization.
9. Cancellation, rescheduling and refunds
A cancellation or rescheduling request must be sent in writing to contact@kingmining.co. The notice is effective when received by King Mining. For a booking containing several services or visit days, the “service date” means the first scheduled service date.
A refund for a non-government King Mining service may be available only when:
- King Mining receives written cancellation notice at least 72 hours before the service date;
- King Mining has not registered, reserved, ordered, committed, commenced or made arrangements for that service; and
- the amount has not become payable or non-refundable to another person or organization.
An approved refund will be reduced by actual bank charges, intermediary-bank charges, payment-processing fees, transfer costs, currency-conversion losses and exchange-rate differences connected with receiving or returning the payment. The refunded amount will therefore ordinarily be less than the amount originally paid.
Government-related amounts remain subject to Section 8. Direct third-party payments remain subject to Section 7. Notice received less than 72 hours before the service date does not qualify for a refund. Failure to attend, late arrival, voluntary early departure or inability to travel does not create a right to a refund for services already arranged, reserved, committed or made available.
A visa refusal does not automatically create a right to a refund. Any non-government service amount that remains wholly unarranged and uncommitted will be considered under the conditions above. Rescheduling is subject to availability, continued validity of approvals and payment of any additional external cost. King Mining will not impose its own rescheduling penalty solely because the Client’s plans changed.
10. Cancellation or refusal by King Mining
King Mining may postpone, modify, suspend, refuse or cancel a service or visit before or during its performance where reasonably necessary for government compliance, safety, security, mine operations, road conditions, weather, authorization, local circumstances, suspected unlawful activity, inaccurate information, breach of these Terms or instructions from a competent authority, mine owner, mine operator or security provider.
Where King Mining cancels solely because a service cannot safely or lawfully proceed and the Client is not in breach, King Mining may offer a reasonable rescheduled date or return any unused and uncommitted amount paid for a King Mining service, after deducting non-refundable government-related amounts and properly incurred or committed costs. Direct third-party payments remain governed by the relevant provider’s terms.
If a service or visit is refused, suspended or terminated because a Client or Visitor breached these Terms, violated site rules, supplied false or incomplete information, ignored an instruction or created a safety, security, legal or confidentiality risk, King Mining may end the service immediately and no refund will be due for affected services or arrangements.
11. Visitor responsibilities
The Client and every Visitor must:
- provide accurate identity, company, travel, health and visit-purpose information;
- carry a valid passport or government-issued identification and present it when lawfully requested;
- obtain and maintain appropriate travel, medical, evacuation and accident insurance;
- obtain any visa or travel document not expressly included in King Mining’s confirmed service;
- disclose in advance any medical condition, allergy, disability or mobility limitation reasonably relevant to safe transport, accommodation or mine access;
- follow all lawful instructions issued by King Mining, government authorities, mine owners, mine operators, drivers, engineers, security personnel and safety personnel;
- use required protective equipment and attend any required safety briefing;
- remain with the approved group and use only approved routes, vehicles, entrances and facilities;
- act professionally and comply with applicable Afghan law, local requirements and site rules; and
- avoid conduct that threatens people, property, operations, confidentiality, community relations or the environment.
Disclosure of a condition does not guarantee that accommodation is possible. King Mining may request further information reasonably necessary to assess safety or may decline participation where the planned visit cannot be conducted safely or practically.
12. Mine rules, restricted activities and confidentiality
Mine locations and related operations contain sensitive commercial, technical, governmental and security information. Protecting that information is a fundamental condition of every visit.
Without King Mining’s prior written permission and any additional permission required from the mine owner, operator or competent authority, a Client or Visitor must not:
- enter, approach or attempt to access a restricted, unapproved or unattended area;
- collect, handle, mark, divide, remove, transport or retain any mineral, ore, soil, rock, water or other sample;
- operate, launch, carry for use or arrange the use of a drone or other aerial-recording device;
- take photographs, make audio or video recordings, livestream, scan, map or record coordinates;
- copy, transmit, publish or disclose documents, permits, licences, maps, routes, coordinates, security arrangements, government processes, identities, contacts, prices, commercial terms, operational details, geological observations, estimated capacity, sample information, laboratory information or other non-public information;
- interview, direct, employ, pay or make private arrangements with site workers, operators, officials, community representatives or service personnel outside the approved visit process; or
- share visit information through social media, messaging services, websites, presentations, media interviews or third-party reports.
“Confidential Information” means any non-public information learned, observed, received or created in connection with the request, coordination or visit, whether communicated orally, visually, electronically, in writing or through physical access. It includes the categories listed above and the existence or substance of sensitive coordination. Information is not confidential to the extent the Client can demonstrate that it lawfully entered the public domain without breach of these Terms or was lawfully possessed without a duty of confidence before disclosure by King Mining.
Confidential Information may be used only to evaluate the legitimate business purpose approved for the visit. It may be shared only with the Client’s personnel and professional advisers who genuinely need it for that purpose and are bound by confidentiality duties at least as protective as these Terms. The Client remains responsible for disclosure by its Visitors, personnel and advisers.
If disclosure is required by a binding legal order, the Client must, where legally permitted, notify King Mining promptly before disclosure, disclose only what is legally required and take reasonable steps to preserve confidentiality.
These confidentiality obligations continue after the request, visit and any commercial discussion ends and remain in effect for as long as the information remains non-public and commercially, technically, operationally or security-sensitive. Unauthorized access, sampling, photography, recording or disclosure may result in immediate removal, termination of services, refusal of future access and legal action under applicable law.
13. Health, safety and inherent risks
Travel in Afghanistan and entry into remote, mountainous, industrial or active mining areas involve inherent risks. These may include difficult roads, changing weather, altitude, dust, noise, heavy vehicles and machinery, uneven or unstable ground, falling material, limited communications, limited medical facilities, delays, civil or security events and other conditions that cannot always be predicted or eliminated.
Every Visitor must independently assess whether participation is appropriate, obtain suitable professional travel, security and medical advice, and maintain adequate insurance. By choosing to participate after receiving available instructions, each Visitor acknowledges and accepts the ordinary and inherent risks of the approved activity. This acknowledgement does not remove any right or responsibility that cannot lawfully be excluded under Afghan law.
King Mining may change a route, restrict an activity, require protective measures, delay departure, evacuate a location or end a visit without advance notice where considered necessary for safety or security.
14. No commercial commitment
A request, payment, authorization, meeting, mine visit, inspection, sample, assay, discussion or exchange of information does not require any person to purchase or sell minerals, invest, grant representation or exclusivity, enter a partnership or joint venture, award a licence, reserve production, or conclude any other transaction.
Any future commercial relationship requires a separate written agreement signed by authorized representatives of the relevant parties. Mine observations, preliminary statements, samples and laboratory results must not be interpreted as a warranty of reserves, future production, continuous availability, quantity, grade, recovery, merchantability, suitability for a particular process or the terms of a future transaction unless expressly stated in that separate agreement.
15. Delays and events outside our control
King Mining does not guarantee a particular approval date, travel time, route, mine-access time, itinerary or completion date. We are not responsible for failure or delay caused by circumstances reasonably outside our control, including government action or inaction, refusal or withdrawal of authorization, closure of a mine or road, mine-owner or operator decisions, security events, conflict, civil disturbance, weather, flood, earthquake, fire, accident, illness, epidemic, border or transport disruption, fuel shortage, telecommunications failure, labour disruption or failure of an independent provider.
When such an event occurs, King Mining may adjust, postpone or cancel the affected service. The refund and rescheduling rules in Sections 7, 8, 9 and 10 will apply according to the type of payment and the arrangements already made.
16. Responsibility and service limitations
King Mining is responsible for performing only the services expressly accepted in its written confirmation, subject to these Terms. We do not guarantee visa issuance, government authorization, access on a particular date, road or security conditions, the uninterrupted performance of an independent provider, mineral availability, mineral quantity or grade, sample representativeness, laboratory outcomes or the conclusion of a commercial transaction.
King Mining is not responsible for loss or delay caused by a Client’s or Visitor’s breach, inaccurate or late information, failure to obtain required documents or insurance, disregard of instructions, unauthorized conduct, direct contract with a third party, or an event described in Section 15. Nothing in these Terms excludes or limits a responsibility that cannot lawfully be excluded or limited under Afghan law.
17. Privacy and personal information
King Mining handles personal information in accordance with its Privacy Policy. Information may be used to evaluate a request, verify identity, process payment, communicate with Visitors, arrange services, support government documentation, manage safety and security, maintain records and address legal or operational requirements.
Where reasonably necessary for the requested service, information may be shared with competent authorities, mine owners and operators, hotels, transport providers, laboratories, translators, engineers, security providers and other persons involved in the approved arrangements. The Client confirms that it is authorized to provide the personal information submitted for each Visitor and has informed each Visitor about the relevant processing.
18. Governing law and courts
These Terms, every confirmed service and any non-contractual matter arising from them are governed by the laws of Afghanistan. The courts located in Kabul, Afghanistan will have jurisdiction over any dispute, claim or proceeding arising from or connected with these Terms, a request, a booking, a payment or a visit.
Before beginning court proceedings, the parties should first attempt in good faith to resolve the matter through written communication. A complaint should include the booking reference, relevant dates, a clear description of the issue and the requested resolution. This informal process does not prevent either party from seeking urgent relief where necessary to protect safety, property or Confidential Information.
19. General provisions
Entire agreement
These Terms together with the accepted written quotation, invoice, itinerary, confirmation and any signed site-specific acknowledgement form the entire agreement for the confirmed service and replace earlier discussions about that service.
Changes to these Terms
King Mining may update these Terms for future requests. The version accepted for a confirmed booking will continue to govern that booking unless a change is required by law or agreed by the parties in writing.
No waiver
A delay or failure to enforce a provision is not a waiver of that provision or of the right to enforce it later.
Severability
If a court finds any provision invalid or unenforceable, that provision will be applied to the greatest extent permitted by law and the remaining provisions will continue in effect.
Assignment
The Client may not transfer a booking or any right under these Terms to another person or organization without King Mining’s prior written approval. King Mining may use personnel and independent providers to perform or coordinate confirmed services.
Electronic communications and acceptance
The parties may communicate and provide confirmations by email or through the website. Selecting an acceptance checkbox, submitting a request that expressly incorporates these Terms, accepting a quotation or making the required payment constitutes acceptance to the extent permitted by applicable law.
